Abstract

Individuals charged with misdemeanors who are incompetent to proceed in the legal system have significant psychotic symptoms, functional impairment, and limited support and access to resources. We discuss research from our group as well as pathways to provide care while attempting to prevent the criminalization of mental illness.

At the conclusion of the activity, the speakers will

  • Define competency to stand trial
  • Describe the clinical features of incompetent misdemeanor defendants
  • Provide an example of a proposed pathway that may better serve these individuals and the community
